These terms and conditions constitute an agreement between you, the user (‘’you’’ or ‘’your’’) and Teke Payments Limited a Kenyan Corporation who are the sole owners of Teke Taxi (‘’we’’ ‘’us ‘’or ‘’our’’) that governs the use of Teke Taxi Application, website and technology (collectively ‘’Services’’) We have developed the (Teke Taxi) service to make it easier to hail a cab, ride, and pay in a convenient way without having to deal with arbitrary drivers and hence improving your taxi experience!Therefore we have drafted this Customers Terms of Service as simple as possible to make you easily understand our operations.
Teke Taxi provides a platform that enables the users to request for transportation through our mobile application or website (services) to third parties providers of the same who are under an agreement with Teke Taxi to provide such services. It is therefore prudent to note that TEKE Payments Limited is not a transportation company and does not offer transportation services. Teke Taxi has no liability to transportation provided to you by third party drivers and operators. The decision to use our services is made solely by the user at their own discretion.
In order to use the service you are required to register with Teke Taxi and warrant that the information you provide is truthful and accurate. Teke Taxi is under no obligation to verify the accuracy of the information you provide. Our services are only available to users with full legal capacity therefore any under aged individual should be able use our services with supervision from a person of legal representative. Once you have registered on our platform you cannot in any way transfer your registration to a third party. If you become aware of any unauthorized use of your account, or any other related account security breach you will immediately inform Teke Taxi in writing.
Teke Taxi gives a limited, non-transferable, non-commercial, fully revocable rights to access and fully use our services in your personal computer or mobile phone in agreement with this Terms and Conditions. Teke Taxi is not liable to damage by any User who has copied, transferred, distributed or use any protected content from our services to violate the rights of others. All rights not expressed herein are reserved by Teke Taxi.
This is any information you provide through the Teke Taxi platform and any other related sites which includes the information you provide through Teke Taxi related social sites including but not limited to twitter, Facebook. Your consent to us using your information to create your Teke Taxi account will allow you to access and use our services. Our collection and use of your information is covered in the Privacy Policy.
You are solely responsible for the information on your account and interactions with the general public. It is therefore your responsibility to ensure that the information you provide is accurate, current and complete.
It also your responsibility to protect the discretion of your password. You are responsible for all the activity that takes place under your User account and Teke Taxi will not be held liable to any unauthorized activity under your account.
You are required to obey all laws and regulations that are applicable to your use of Teke Taxi application. Thus you are not allowed to use Teke Taxi services to
This service may allow you access or connect to third party entities services. When you access these services you do at your own risk. These services are not under Teke Taxi’s control and you acknowledge that Teke Taxi is not responsible or liable to content, functions, appropriateness, accuracy, legality or any other aspects of such services. These third parties are not part of this agreement and are not responsible for any provision or support of Teke Taxi in any way.
Teke Taxi may rely on the services of third party for marketing and advertising supplied through the website and other mechanisms. By agreeing to these terms and condition, you agree to receive such advertising and marketing.
As a user you agree that the amount chargeable (charges) are compulsory and payable after receiving the services using Teke Taxi. These charges are non-refundable and apply even if you decide to stop using the system or we stop your use of the system, any malfunction or disruption to the software whether planned, accidental or intentional.
The fare displayed in the ‘’Fare Estimation’’ is a mere estimate. The actual fare will be displayed at the end of the trip and that is the amount you are expected to pay. The Company is not responsible for any variations between the estimate and the actual fare.
Teke Taxi has the authority and reserves the right to modify or change the charges as it deem necessary. The ride fees consist of base fare and incremental charges based on the distance covered and time taken on your ride. For the short rides, the minimum ride fees will apply. You are able to get an estimate of the fare you will be charged before submitting your request for a taxi. The estimate however might be different though slightly from the eventual amount at the end of the ride because of several factors during the ride.
The charges apply immediately after receiving goods and services from Teke Taxi and are meant to compensate the Third Party Provider for the goods and services offered. After you are charged a receipt is sent immediately to your email. The primary mode of payment is cash. You can also use your credit/debit card or Mobile Money to make the payments. In the event your credit card is found expired, invalid or not chargeable Teke Taxi will use a secondary method, if available to collect the charges from you.
By becoming a User, you expressly consent to receiving communications from Teke Payments Limited, either through email, sms, calls and push notifications from to the cellular number you provided upon registration.
If you wish to opt-out of promotional emails, text messages, or other communications, you may opt-out by following the unsubscribe options provided to you, including the “end” and “stop all” options.
By accepting these User Terms and using the Application, you agree that you shall defend, indemnify and hold the Company, its affiliates, its licensors, and each of their officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) arising out of or in connection with:
TEKE TAXI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF UBER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TEKE TAXI SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF:
TEKE TAXI SERVICES MAY BE USED BY YOU TO REQUEST AND SCHEDULE TRANSPORTATION OR LOGISTICAL SERVICES WITH THIRD PARTY PROVIDERS, BUT YOU AGREE THAT TEKE TAXI HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY TRANSPORTATION OR LOGISTICS SERVICES PROVIDED TO YOU BY THIRD PARTY PROVIDERS OTHER THAN AS EXPRESSLY SET FORTH IN THESE TERMS.
You agree that any disputes arising out of or relating to this Agreement or the Teke Taxi Services will be resolved in accordance with this Section. This Agreement is governed by the laws of Kenya without regard to its choice of law provisions. The exclusive venue for any actions or claims arising under or related to this Agreement will be the federal courts located in Nairobi, Kenya.
We have the right to change or add to the terms of this Agreement at any time, and to change, delete, discontinue, or impose conditions on any feature or aspect of the Teke Taxi Services or software with notice that we in our sole discretion deem to be reasonable in the circumstances. Any use of the Teke Taxi Services or software after our publication of any such changes will constitute your acceptance of this Agreement as modified.
This Agreement and any rights or licenses granted hereunder may not be transferred or assigned by you without our prior written consent, but may be assigned by us without consent or other restriction upon notice to you or where substantially all of Teke Payment Limited’s assets are sold. Any attempt by you to assign this Agreement, or any rights or licenses granted herein, without Teke Payments Limited’s express written consent will be null and void.
